COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is provided on a weekly basis.


LEGISLATION CHANGES

Public Health (Restricted Activities - Gatherings, Business or Undertakings) Emergency Direction 2021 (No 3)

  • Restricts non-essential gatherings and the operation of non-essential businesses and undertakings in order to limit the spread of COVID-19.

COVID-19 Concerns Notice and Exemption

  • Identifies affected areas and places of high concern.

Public Health (COVID-19 Gathering Restrictions) Amendment Order 2021

  • Amends the Public Health (COVID-19 Gathering Restrictions) Order 2021 to clarify that contact details provided under this order may only be used for the purposes of contact tracing during the COVID-19 pandemic and not for any other purpose.

Public Health (COVID-19 Gathering Restrictions) Order 2021

  • Revokes and remakes, with some changes, the Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2021 including increasing the number of persons allowed at certain places, removing requirements for COVID-19 Safety Hygiene Marshals, removing singing and dancing restrictions.


Aged Care Direction (No. 26)

  • Provides requirements for aged care facilities and visitors of aged care facilities to assist in containing, and responding to, the spread of COVID-19.

Requirements for Quarantine Facility Workers Directions

  • Protects the health of the community and individuals working in quarantine facilities by mitigating the spread of COVID-19.


Emergency Management (Cross Border Travel - Associated Direction No 4) (COVID-19) Direction 2021

Emergency Management (Public Activities No 22) (COVID-19) Direction 2021

  • Imposes principles and rules relating to the conduct of certain activities involving members of the public, the management of places in which those activities occur, and the management of contact tracing records.


Directions in Relation to Persons Arriving in Tasmania

  • Requires persons arriving in Tasmania to provide certain information, and to isolate in an accommodation facility if required, and restricts certain persons from arriving in King Island, Flinders Island or an island in the Furneaux group of islands, among other things.

Care Facilities Directions (No 26)

  • Restricts access to care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11.59 pm on 9 April 2021.

Diagnosed Persons and Close Contacts Directions (No 21)

  • Requires persons diagnosed with COVID-19 to self-isolate and persons who are living with a diagnosed person, or close contacts, to self-quarantine - came into force at 11.59 pm on 9 April 2021.

Extension of Declaration of a State of Emergency

  • Extends the declaration of a state of emergency made on 16 March 2020 until 11:59 pm on 7 May 2021 - came into force at 11:59 pm on 9 April 2021.

Hospital Visitor Directions (No 23)

  • Prohibits certain visits to hospitals in order to limit the spread of COVID-19 - came into force at 11.59 pm on 9 April 2021.

Restricted Activity Directions (Victoria) (No 12)

  • Restricts the operation of certain businesses and undertakings in the State of Victoria to address the serious public health risk posed to Victoria by COVID-19 - came into force at 11:59 pm on 9 April 2021.

Stay Safe Directions (Victoria) (No 19)

  • Requires residents of Victoria to limit interactions with others by restricting gatherings, and to carry and wear face coverings in certain settings - came into force at 11:59 pm on 9 April 2021.

Victorian Border Crossing Permit Directions (No 9)

  • Continues to provide a ‘traffic light’ border crossing scheme for persons seeking to enter Victoria from any other State or Territory or after entering Australia from a Green Zone Country - came into force at 11:59 pm on 9 April 2021.

Workplace (Additional Industry Obligations) Directions (No 21)

  • Places additional specific obligations on employers and workers in specific industries in relation to managing the risk of COVID-19 - came into force at 11.59 pm on 9 April 2021.

Workplace Directions (No 24)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of outbreaks of COVID-19 and to establish more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm on 9 April 2021.



Extension of Declaration (No. 2) of Public Health State of Emergency

  • Extends the public health state of emergency which came into effect on 23 March 2020 for 14 days.

  • Extends the state of emergency for 14 days.


COVID-19 Public Health Response (Air Border and Isolation and Quarantine) Amendment Order 2021

  • Amends the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 so that confirmed allocation and managed isolation allocation system have the meanings given in the Isolation and Quarantine Order and the COVID-19 Public Health Response (Isolation and Quarantine) Order 2020 to provide that the chief executive of the Ministry of Business, Innovation, and Employment is responsible for the operation of the managed isolation allocation system.

COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order (No 2) 2021

  • Amends the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 to prohibit certain air carriers from causing aircraft to arrive in NZ and prohibiting persons arriving in NZ by air if they have been in India within the 14 immediately before the date of their arrival.
